DMCA Notice.
Off the Grid respects the rights of copyright holders. If you believe that material accessible on the Society infringes your copyright, you may file a notice under the U.S. Digital Millennium Copyright Act (17 U.S.C. § 512) and we will respond promptly.
Where to send a notice
Our designated copyright agent is:
DMCA Agent — OTG Mercantile
Email: dmca@offthegrid.club
Subject line: DMCA Takedown Notice — [your name]
What your notice must include
To be effective under the DMCA, your written notice must contain substantially the following:
- A physical or electronic signature of the owner, or a person authorized to act on behalf of the owner, of an exclusive right that is allegedly infringed.
- Identification of the copyrighted work you claim has been infringed (or, if multiple works, a representative list).
- Identification of the material on the Society that you claim is infringing, with enough detail for us to locate it (a URL is ideal).
- Your contact information — name, address, telephone number, and email.
- A statement that you have a good-faith belief that the complained-of use is not authorized by the copyright owner, its agent, or the law.
- A statement, under penalty of perjury, that the information in your notice is accurate and that you are the owner or authorized to act on the owner’s behalf.
Counter-notices and repeat infringers
If you believe content of yours was removed in error, you may file a counter-notice at the same address, including a statement under penalty of perjury that you have a good-faith belief the material was removed by mistake or misidentification. We maintain a policy of terminating, in appropriate circumstances, the accounts of members who are repeat infringers.
Misuse of the DMCA process — for example, filing a knowingly false notice — may subject you to liability under 17 U.S.C. § 512(f).
